Terms and Conditions

Purchase any stickered Bumper Bar and text in your unique code to 400, to WIN one of 1000 free song downloads or one of ten $500 Marbecks gift vouchers.

How to enter:
1. Buy any single Bumper Bar with a promotional sticker adhered to it;
2. Consume the bar so that you can open up the wrapper and view the underside of the promotional sticker;
3. Using your mobile phone, TXT the letters BAR, followed by a space, and then the unique code from the sticker, to 400.

Retain your wrapper with the promo sticker as proof of purchase. The Promoter (Cookie Time Limited) reserves the right to request proof of purchase for each entry made to verify all entries before awarding the prize. Failure to provide these to the Promoter upon request may, at the Promoter's discretion, result in an invalid entry. Entries are deemed accepted at the time of receipt and not at the time of transmission. Consumers may enter as many times as they like provided each entry is associated with a separate purchase of a Bumper Bar and uses a unique code (not previously used).

Terms and Conditions
General

1. Entry instructions form part of these terms and conditions of entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Full Terms and Conditions are housed at www.bumperbar.co.nz.

3. The promotion is open to all New Zealand residents except employees of the Promoter, its franchised distributors, its agencies associated with this offer (in this case, the employees of Marbecks and Mobileez) and their immediate family members.

4. Entries are open to anyone having made a valid Bumper Bar purchase, regardless of age.

5. The promotion commences at 12.01am on August 30th 2010 and entries close at 11.59am on November 5th 2010 ("the Promotional Period").

6. Prize winners will be draw on Friday each week throughout the promotional period. All prize winners will be notified by TXT.

7. Each valid TXT entry requires the entrant to purchase an individual stickered Bumper Bar from participating retailers. The TXT must be sent from a New Zealand mobile number to 400. The individual’s usual network changes apply. An auto-reply will be sent via TXT to confirm receipt of valid entries. No return TXT fee will be charged.

8. Entrants are limited to one entry per product purchased. Where multiple entries of the same code number are entered, only the first entry will be deemed legitimate and will be entered into the prize draw.

9. Incomplete or indecipherable entries or claims will be deemed invalid.

10. There is a total of 1000 song downloads and 10 x $500 Marbecks Gift Vouchers in the overall prize pool. Winners will be selected randomly from all valid entries received within the Promotional Period.

11. The Promoter's decision is final and no correspondence will be entered into. The Major Prize Winners (10 x $500 Marbecks Gift Vouchers) will sent a TXT asking them to contact 0800 266543 to claim their prize. This claim will consist of verification of their mobile phone number (the number will be verified against the official number drawn).

12. Once verified, the prize will be sent by courier, which will need to be signed upon receipt. Only one Major Prize will be attributed to each verified winning number. Subsequent claims be made from the same number will be treated as illegitimate.

13. Any prizes not claimed by 30 April 2011 will be deemed as void.

14. Prize are non-transferable and are not redeemable for cash. Prizes cannot be on-sold by the winner.

15. The claiming of songs from marbecksdigital.co.nz site is a transaction between Marbecks and the prize winner. All queries will be attended to by the Marbecks staff via http://www.marbecksdigital.co.nz/helpcontact.aspx.

16. The person whose mobile service is used to send the TXT message is deemed the Entrant. Entrants who use another person's phone may be disqualified. TXT entries via the internet are not valid and will not be accepted. The TXT entry mechanic is only open to consumers with a TXT compatible mobile phone connected to a service provider, which permits text messaging to the promotional TXT number. It is recommended that entrants check with their individual service providers in this regard. TXT winners will be contacted by telephone and the Promoter will record their address details so that their prize may be awarded. The Promoter will use the mobile number provided for entry purposes to make contact. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. The service provider is Mobileez (www.mobileez.com).

17. Prize-winners will be notified on a weekly basis throughout the promotional period. A TXT message will be sent by 5pm each Friday. If no TXT message has been received, no prize has been won (those not winning will not be notified).

18. The Promoter reserves the right to verify the validity of entries, at any time during or after the promotion, and reserves the right to disqualify any entrant (and ALL entries submitted by that entrant) for tampering with the entry process, including but not limited to the use of techniques designed to avoid payment of call costs, and / or for submitting an entry which is not in accordance with these Terms and Conditions. The Promoter reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Incomplete, indecipherable or illegible claims will be deemed invalid. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

19. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those entrants invalid.

20. To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of , or arising out of, or in any way connected with the offer. Except for any liability that cannot be excluded by law, the Promoter, its employees and agents exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer/prize values to those stated in these Terms and Conditions; (e) any tax liability incurred by a winner; or (g) use of a prize.

21. If, for any reason, any part of this offer is not capable of running as planned, including war, terrorism, state of emergency or disaster, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of any part of this offer, the Promoter reserves the right (a) in its sole discretion to disqualify any individual who tampers with the claim/entry process, or may benefit from such tampering, and (b) to cancel, terminate, modify or suspend any or all of parts of the offer. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.

22. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the prize winnings. Independent financial advice should be sought.

23. In the event that a prize is not available despite the Promoter's reasonable endeavours to procure the prize, the Promoter reserves the right to substitute a prize of equal recommended retail value, subject to any written directions from a relevant Regulatory Authority.

24. The Promoter accepts no responsibility for any variation in the prize value.

25. The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with taking the prize, except for any liability which cannot be excluded by law.

26. A prize, or any unused portion of a prize which is not used within the specified period, is not transferable or exchangeable and cannot be taken as cash unless specified otherwise.

27. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person's computer related to or resulting from participating in or downloading any materials in the promotion. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.

28. All entries become the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering this promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
